STANDARD WARRANTY

Geometrica, Inc. (“Geometrica”) hereby offers its Standard Warranty and the listed endorsement(s), if applicable, to the Customer identified below subject to the conditions and limitations set forth in this document.

1. WARRANTY
   1. Geometrica warrants the structural components and accessories manufactured by Geometrica to be in compliance with specifications, plans and drawings furnished by Geometrica to the Customer, free from any defects in material, design and factory workmanship, for a period of Eighteen (18) months from the date of shipment by Geometrica, or one year from completion of the installation, whichever is earlier.
   2. Geometrica warrants that exterior PVDF coated cladding shall not crack, check, blister, peel, flake or chip for a period of ten (10) years from the date of shipment by Geometrica, nor shall it fade in excess of 5.0 Hunter units per ASTM D2244 or chalk in excess of No. 8 rating per ASTM D659 for a period of ten (10) years from the date of shipment by Geometrica.
      
      
2. CONDITIONS OF WARRANTY
   
   Any claims of non-conforming goods, materials, components, and accessories must be reported to Geometrica in writing by the Customer within 30 days of the discovery of any instance of non-conformity. Upon the receipt by Geometrica of such notice and the presentation by the Customer of this warranty document, subject to the inspection by Geometrica of the alleged non-conformity, Geometrica shall, at its option, repair, repaint or replace such non-conforming item.
   
   
3. LIMITATIONS AND / OR EXCLUSIONS
   1. This warranty is extended only to the Customer named in this document. Customer expressly agrees that this warranty is not transferable or assignable.
   2. This warranty shall not apply where the goods, building materials, components and accessories have been damaged as a result of misuse, improper storage, accidents, acts of God, or have not been erected, installed or maintained in accordance with applicable Geometrica instructions and good practices of workmanship, or have been damaged during shipment or unloading.
   3. This warranty does not apply where the goods, materials, components or accessories are exposed at any time to conditions beyond those specified in the supply contract.
   4. This warranty will become null and void if modifications are made to the structure or cladding by the Customer without express written consent of Geometrica.
   5. This warranty does not provide for any labor charges for removal and/or reinstallation of any non-conforming goods, building materials, components or accessories.
      
      
4. EXPRESS DISCLAIMER
   
   THE LIMITED WARRANTY SET FORTH IN THIS DOCUMENT SHALL BE GEOMETRICA’S SOLE WARRANTY AND SHALL BE IN LIEU OF ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTY OF MERCHANTABILITY OF FITNESS FOR A PARTICULAR PURPOSE.
   
   
5. LIMITATION LIABILITY
   
   IN NO EVENT SHALL GEOMETRICA BE LIABLE FOR ANY SPECIAL, CONSEQUENTIAL, INCIDENTAL OR INDIRECT DAMAGES WITH RESPECT TO THE BUILDER, AND/OR OWNER, WHETHER BASED UPON CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE.
